ORDER

The Civil Revision is directed against the order passed in I.A.No.3 of 2021 in R.L.T.O.P.No.22 of 2020, dated 15.12.2021 on the file of the III Additional District Munsif Court, Trichy.

2. When the matter is taken up for hearing today, the learned counsel for the respondent would submit that the revision petitioner has preferred an appeal in R.L.T.A.No.1 of 2022 before the Principal District Court (Rent Tribunal), Tiruchirappalli, challenging the very same order passed in I.A.No.3 of 2021 in R.L.T.O.P.No.22 of 2020 and the Rent Tribunal, after enquiry, dismissed the appeal, confirming the order passed by the learned trial Judge, on 28.01.2023. He has also produced the copy of the order passed in R.L.T.A.No.1 of 2022.

3. At this juncture, the learned counsel for the petitioner seeks permission of this Court to withdraw this petition with liberty to challenge the order passed by the Rent Tribunal and he has also made an endorsement to that effect.

4. In view of the endorsement made by the learned counsel for the petitioner, the Civil Revision Petition is dismissed as withdrawn. The petitioner is at liberty to challenge the order passed by the Rent Tribunal. Consequently, connected Miscellaneous Petition is closed.
