ORDER

This Writ Petition is disposed of at the time of admission with the consent of the learned counsel for the petitioner and learned Special Government Pleader for the respondent.

2. The petitioner claims that the petitioner was elected in the year 2007. However, there is a Writ Petition filed by another person, namely, P.Jeyakumar claiming himself as Secretary to the petitioner's association, wherein he had challenged the order of the District Registrar/respondent herein in his proceedings bearing reference in Na.Ka.1537/A3/216, dated 25.07.2016.

3. By the aforesaid order, the first respondent therein appears to have directed the parties to workout remedy before the Civil Court. It appears that neither the petitioner nor the said Jeyakumar/Writ Petitioner in W.P.(MD) No. 18503 of 2016 has filed a suit.

4. It is case of the petitioner that since no suit was filed by the said Jeyakumar, there is no impediment for accepting the Form 7, pursuant to the 2/4

elections held in 2007. A copy of the order, dated 25.07.2016, bearing reference in Na.Ka.No.1537/A3/216, which is the subject matter of W.P.(MD) No.18503 of 2016 on behalf of the petitioner's association, although represented by its Secretary P.Jeyakumar, is not before this Court. It indicates that the parties have to work out remedy before the Civil Court in view of the rival claim.

Considering the fact that the order was disposed of on 16.12.2024 by this Court, there shall be a direction to the respondent to consider the petitioner's representation, dated 03.02.2025 on merits, after duly considering the order, dated 25.07.2016 bearing reference in Na.Ka.No.1537/A3/2016 as expeditiously as possible preferably within a period of six (6) weeks from the date of receipt of a copy of this order.
