PRAYER : Criminal Original Petition is filed under Section 482 of Cr.P.C, to direct the respondents 1 and 2 to provide adequate police protection to the life and limb of the petitioner besides initiating criminal action against the third respondent, Veerasekar. For Petitioner : Mr.N.Balakrishnan For R1 and R2 : Mr.B.Thanga Aravindh Government Advocate Crl.Side) O RDER This Criminal Original Petition is filed seeking for a direction to the respondent Police to take action in respect of a memorandum issued by the petitioner dated 14.06.2023. 1/4

It is submitted by the learned counsel for the petitioner that the petitioner and more than twenty persons were given pattas in respect of the landed properties situated in Chidambara Viduthi Village, Aranthangi Taluk, Pudukkottai District. However, one Mr.Karuppaiah Konar, who is not entitled to get a patta was also managed to get a patta, thereby, beneficiaries filed O.S.No.105 of 2014 against the said Karuppaiah Konar for declaration of title and during the pendency of the said suit, the said Karuppiah Konar has mortgaged the property in favour of his brother-in-law, the defendant No.9 in the said suit, who in turn had sold the same in favour of Defendant No.10, the respondent No.3 herein, who remained exparte in the said suit. Having remained exparte in O.S.No.105 of 2014, respondent No.3 is allegedly trying to encroach the land belonging to the petitioner and others with the help of JCB and aggrieved by the same, a complaint has been given to the police, but, no action has been initiated.
3. Learned Government Advocate (Criminal Side) on the other hand submits that civil disputes are pending between the petitioners on the one hand and respondent No.3 on the other hand. Earlier, three complaints were filed in respect of the said dispute and Police have 2/4
registered them as C.S.R.Nos.458 of 2023, 878 of 2021 and 716 of 2021 and were disposed of in spite of it, they are not adhering to resolve the dispute in the Civil Court.
4. Considering the same, respondents are directed to consider the representation filed by the petitioner in respect of the incident that is alleged to have been taken place on 05.06.2023 and disposed of within a period of two weeks from the date of receipt of a copy of this order.
