Prayer : Petition filed under Article 226 of the Constitution of India for issuance of Writ of Certiorarified Mandamus, calling for the records relating to the impugned order passed by the first respondent vide proceedings in No. RO.TRY/208/2026-CA dated 03.06.2026 and quash the same as illegal and Consequently direct the first respondent to grant 28 days ordinary leave without police escort to the petitioner's husband, namely, Stalin, s/o.Ganesan, aged about 40 years, life convict, PID No. 294802 confined at Central Prison, Trichy.

O R D E R
[Order of the Court was made by N.ANAND VENKATESH, J.] This writ petition has been filed challenging the impugned proceedings of the first respondent made in No. RO.TRY/208/2026-CA dated 03.06.2026 and for a consequential direction to the first respondent to grant 28 days ordinary leave without police escort to the petitioner's husband, who is presently serving sentence at Central Prison, Trichy.
2. Heard the learned counsel on either side.
3. The petitioner's husband is a life convict and he is serving sentence at Central Prison, Trichy. A representation was made by the petitioner stating that she is suffering from serious ailments and she required the physical and moral support of her husband. This representation came to be rejected by the first respondent through the impugned proceedings dated 03.06.2026 on the ground that the report of the Probation Officer has not been received. Aggrieved by the same, the present writ petition has been filed before this Court.
4. The learned counsel for the State of Tamil Nadu (Criminal Side) on instructions submitted that the convict has undergone sentence of six years, seven months and four days and was granted emergency leave on seven occasions and ordinary leave on one occasion.
5. Taking into consideration the facts and circumstances of the case and the reason for which the ordinary leave has been sought for and considering the fact that on earlier occasions, the convict was granted
leave and nothing untoward took place, we are inclined to interfere with the impugned proceedings of the first respondent dated 03.06.2026 and the same is hereby set aside. There shall be a direction to the first respondent to grant 28 days ordinary leave to the convict subject to the condition that the convict will report before the fourth respondent Police daily at 05.00 p.m., during the entire period of ordinary leave. The sureties will be furnished by the convict before the Jail Authorities.
