ORDER
Heard the learned counsel for the petitioner and the learned Special Government Pleader for the respondents 1 to 6. Considering the nature of relief to be granted, issuance of notice to the respondents 7 to 9 is dispensed with. 2.The petitioner is a resident of Kodalvavi Village. He alleges that a channel known as Odai of Mangarai river flowing through the petition mentioned survey numbers has been encroached upon by the private 2/5
respondents. The petitioner wants the encroachment to be removed. Since his request has not been considered or acted upon by the authorities, the present Writ Petition came to be filed.
3.When the matter was taken up for hearing, the learned Special Government Pleader conceded that the petition mentioned water channel runs through the petition mentioned survey numbers. 4.We direct the third respondent to conduct survey. If encroachments are noticed, notices shall be given to all the encroachers / interested parties and opportunities should be given to them and they will be removed by adhering to due process of law. The entire exercise shall be completed within a period of four months from the date of receipt of a copy of this order. 5.This Writ Petition is allowed accordingly. There shall be no order as to costs.
