For Respondent : Mr.K.Suyambulinga Bharathi, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.1442 of 2020 on the file of the Respondent Police.
ORDER : The Court made the following order :- Heard the learned counsel appearing for the petitioner and the learned Government Advocate(Crl. Side) appearing for the respondent. 2.The petitioner apprehending arrest at the hands of the respondent police for the offences punishable under sections 406, 409, 420, 468 and 471 of I.P.C., in Crime No.1442 of 2020 on the file of the respondent police, seeks anticipatory bail. 3.The case of the prosecution is that the petitioner was working Manager in the defacto complainant's bank and he helped A1 for stealing the jewels which were pledged by various customers. Therefore, he caused loss to the bank to the tune of Rs.1,11,28,910/-.
4.The learned counsel for the petitioner submitted that even according to the prosecution, there was only one transaction during his tenure i.e., on 07.06.2019. Subsequently, he was transferred and https://hcservices.ecourts.gov.in/hcservices/ 1/2
CRL OP(MD). No.14259 of 2020 promoted as Branch Head to Nagapattinam branch. Therefore, he has not committed any offence as alleged by the prosecution. 5.The learned Government Advocate (Crl. Side) would submit that all the accused consipered together and committed serious offence and therefore, the custodial interrogation of the petitioner is required. He further submitted that the other accused filed Crl.O.P.(MD)No.14191 of 2020 for anticipatory bail and the same was dismissed by this Court. Hence, he prays for dismissal of this petition.
6. Considering the aforesaid facts and the petitioner also helped the other accused to commit the offence, this Court is not inclined to grant anticipatory bail to the petitioner.
