PRAYER: Criminal Original Petition is filed under Section 528 of BNSS Act, 2023, to recall the Non Bailable Warrant issued on 09.01.2026 in S.C.No.627 of 2025 on the file of the District and Sessions Court for Communal Clash Cases, Madurai and thus render justice.

ORDER

The present petition has been filed by Accused No.1 in S.C.No.627 of 2025 on the file of the District and Sessions Court for Communal Clash Cases, Madurai seeking to recall the Non Bailable Warrant issued on 09.01.2026. 1/4

2. According to the learned Counsel appearing for the petitioner, the petitioner was arrested on 09.01.2026 in some other case and he is in judicial custody; therefore, he could not appear before the Court. He further submits that the petitioner is ready to cooperate with the trial and undertakes to surrender on or before 25.06.2026.

3. The learned Government Advocate (Criminal Side) appearing for the respondent submitted that the petitioner has 57 previous cases and, therefore, is not entitled to seek the indulgence of this Court.

4. In view of the above facts, the petitioner shall surrender before the concerned Court on 25.06.2026. Upon such surrender, the learned District and Sessions Judge for Communal Clash Cases, Madurai, is directed to accept the same and consider the bail petition on the very same day.

5. With the said observations, this Criminal Original Petition is disposed of.
