For Respondent : Mr.R.Erottuchamy, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C. PRAYER :- For Anticipatory Bail in Crime No. Not Known of 2020 on the file of the respondent police.

ORDER : The Court made the following order :- The petitioner, who is arrayed as accused, apprehending arrest at the hands of the respondent police for the offence punishable under Section 21(1) of Tamil Nadu Mines and Minerals (Development & Regulations) Act r/w 379 IPC, in Crime No.Not Known of 2020, seeks anticipatory bail.

2.This is the second anticipatory bail petition. Earlier this Court by order dated 03.09.2020 in Crl.O.P(MD)No.9235 of 2020 dismissed the anticipatory bail petition on the ground that the petitioner is a habitual offender and also eight previous cases are pending against him.

3.The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely https://hcservices.ecourts.gov.in/hcservices/ 1/2

CRL OP(MD).No.14453 of 2020 implicated in this case. He further submitted that the petitioner is ready and willing to surrender before the concerned Court and prayed that bail petition may considered on the same day on merits and in accordance with law.

4.Considering the request of the learned counsel appearing for the petitioner, this Criminal Original Petition is dismissed. However, if the petitioner surrenders before the concerned Court in Cr.No.398 of 2020 and if any bail petition is filed by the petitioner, it may be considered on the same day on merits in accordance with law.

5.Accordingly, this Criminal Original Petition stands dismissed.
