For Respondent : A.Robinson, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- for Anticipatory bail in Crime No.394 of 2019 on the file of the Respondent Police ORDER : The Court Made the following order :- The petitioner apprehending arrest at the hands of the respondent police for the alleged offences punishable under Sections 4(1)(aaa) and 4(1-A) of Tamil Nadu Prohibition Act and Sections 468 and 420 of IPC, in Crime No.394 of 2019, seeks anticipatory bail. 2.Heard the learned counsel for the petitioner. 3.The learned Government Advocate (Crl. Side) appearing for the respondent seriously opposed the grant of anticipatory bail by pointing out that the number of bottles involved is large and that the petitioner is having one previous case.

CRL OP(MD). No.11667 of 2019 4.However, the petitioner is directed to appear before the respondent police and co-operate with the investigation daily at 10.30 A.M for a period of two weeks and thereafter, he shall appear before the respondent as and when required.

5.Subject to the above said condition, this Court is inclined to grant anticipatory bail to the petitioner. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate No.II, Thanjavur and on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and he shall appear before the respondent police as mentioned above. 6.The petitioner shall comply with the conditions stipulated under Section 438 Cr.P.C. Scrupulously.
