This writ petition has been filed to direct the respondent herein to initiate appropriate criminal action under the relevant provisions of law on the basis of the complaint daed 05.11.2020, lodged before the respondent, within the stipulated time as fixed by this Court.
2.The learned counsel appearing for the petitioner reiterated the contention raised in the petition and submitted that it would suffice, if a direction is issued to the respondent to consider the petitioner's complaint, dated 05.11.2020. 3.The learned Additional Public Prosecutor appearing for the respondent would submit that the complaint of the petitioner dated 05.11.2020 will be considered at the earliest. 4.Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondent.
5.Considering the submission made by the learned counsel on either side, without going into the merits of the case, the respondent is directed to consider and take appropriate action against the petitioner's complaint dated 05.11.2020 after giving opportunity to the other side and also by following the principles https://hcservices.ecourts.gov.in/hcservices/ 1/2
W.P.(MD)No.18033 of 2020 laid down by the Hon'ble Apex Court in D.K.Basu Vs. State of West Bengal reported in AIR (1997) SC 610. The said exercise shall be completed within a period of four weeks from the date of receipt of a copy of this order 6.With the above direction, this Writ Petition is disposed of. No costs.
