Respondent Prayer: The petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondent to pass appropriate orders on the petitioner's representation dated 18.06.2019 regarding sub division and grant of patta in respect of 5.65 cents in S.No.149/1 (Plot No.84) of Sankaraperi Village, Thoothukudi Taluk and District within a specified time frame that may be fixed by this Court.

O R D E R

The prayer sought for in this Writ petition is for a Writ of Mandamus, directing the respondent to pass appropriate orders on the petitioner's representation dated 18.06.2019 with regard to sub division and grant of patta in respect 5.65 cents in Survey No.149/1 (Plot No.84) at Sankaraperi Village, Thoothukudi Taluk and District within a time frame.

2.Heard Mr.S.Visvalingam, learned counsel for the petitioner and Mr.V.Anand, learned Government Advocate appearing for the respondent.

3.In order to sub divide and issue patta in respect of 5.65 cents of the above said land, the petitioner has given a representation on 18.06.2019 to the respondent as well as the Director of Town and Country Planning. In this context, it is the submission of the learned counsel for the petitioner that though the property in question had been purchased by the petitioner and plotted out as Plot No.84, so far the patta has not been given. Therefore, the petitioner has made the request to the respondent on 18.06.2019. Therefore, if the said representation is decided by the respondent on merits, within a time frame to be stipulated by this Court, the petitioner would be satisfied.

W.P.(MD)No.17866 of 2019 4.Heard the learned Government Advocate appearing for the respondents, who would submit that, the said representation of the petitioner dated 18.06.2019 would be decided by the respondent on merits, within a time frame and orders would be passed thereon. 5.Having regard to the said submission made by the learned counsel appearing for both sides and taking into account the factual matrix of this case, this Court is inclined to dispose of this Writ petition at the admission stage with the consent of both parties by passing the following order:

That the respondent is hereby directed to consider the representation of the petitioner dated 18.06.2019 and do the needful after providing an opportunity of being heard to the petitioner, if necessary, at any rate, final orders shall be passed, within a period of 6 weeks from the date of receipt of a copy of this order. 6.With this direction, this Writ petition is disposed of. No costs.
