For Respondent : Mr.B.Nambiselvan, Additioanl Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- C-31 AB. For Anticipatory Bail in Crime No.Not known of 2023 on the file of the respondent Police.

ORDER : The Court made the following order :- The petitioner/Accused rank not known, apprehending arrest at the hands of the respondent Police for the alleged offence punishable under Section 420 IPC in Crime No.Not known on the file of the respondent Police.

2. The learned counsel for the petitioner would submit that only the petition

enquiry is pending and so far, no case has been registered.

3. Perusal of enquiry file shows that it is a long issue started from 2021. At one point of time, the learned counsel for the petitioner informed the Court that the complaint given by one Shanmugasundaram was closed, after enquiry. Thereafter, summon was issued and the same was put in challenge before this Court in W.P(MD) No.3296 and 3297 of 2022 that were also closed, in view of the expiry of summon's period. Thereafter, the present complaint is kept pending without any progress.

4. The learned counsel for the petitioner as well as the respondent Police disclosed the above said facts.

5. In view of the above facts, the above said enquiry shall be completed within two weeks from the date of receipt of copy of this order. If any trouble arise during the course of enquiry, the petitioner can workout his remedy through appropriate proceedings. There is no question of granting of anticipatory bail at this stage, since CD file discloses the some other factual aspects.

6. In the result, this anticipatory bail petition deserves dismissal and accordingly dismissed.
