PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- for Anticipatory Bail in Crime No.146 of 2021 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offence punishable under Sections 448, 294(b), 506(2) of IPC in Crime NO.146 of 2021, seeks anticipatory bail.

2.The case of the prosecution is that the petitioner had an illegal contact with the defacto complainant's wife. On 13.09.2021 at about 02.15 p.m., when the defacto complainant was sleeping in the house without locking the door, the petitioner opened his house and damaged the household articles and when the defacto complainant shouted, a quarrel arose between the defacto complainant and the petitioner and that the petitioner scolded the defacto complainant with filthy language him and thereafter, left in the backside of the house.

3.The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case.

4.The learned Additional Public Prosecutor appearing for the respondent police submitted that the investigation is yet to be completed.

5.Considering the facts and circumstances of the case and also considering the gravity of offence, this Court is inclined to grant anticipatory bail to the petitioner.
