Petition filed under Article 226 of the Constitution of India, praying for the issuance of a writ of Mandamus directing the 2nd and 3rd Respondents to consider and pass order on the petition submitted by the petitioner dated 10.09.2012 to grant patta to him for the land in S.No.159/6 (present S.No.159/6A1) in Swamimalai Village Kumbakonam Taluk Tanjore District.

The petitioner seeks for a mandamus directing the the 2nd and 3rd Respondents to consider and pass order on the petition submitted by the petitioner dated 10.09.2012 to grant patta to him for the land in S.No.159/6 (present S.No.159/6A1) in Swamimalai Village, Kumbakonam Taluk Tanjore District.

3. Needless to say that it is for the third respondent to

consider the said representation after giving opportunity of hearing to the petitioner as well as the rival claimants, if any and pass orders on merits and in accordance with law.

4. Therefore, without expressing any view on the claim made by the petitioner, the third respondent is directed to consider the petitioner's representation dated 10.09.2012 on merits and in accordance with law after giving opportunity of hearing to the petitioner as well as the rival claimants, if any within a period of twelve weeks from the date of receipt of copy of this order.

5. With the above direction, this writ petition is disposed of. No costs.
