ORDER : The Court made the following order :- The petitioner/Accused, who was arrested on 10.06.2022 for the alleged offence under Section 366 IPC and Section 6 of the Protection of Children from Sexual Offence Act, 2012 in Crime No.208 of 2022, on the file of the respondent police, seeks bail.
2. The case of the prosecution as per the defacto complainant, who is the grand father of the victim girl, is that the victim girl found missing aged about 12 years in the earlier occasion and she was abducted by one Sheik @ Sheik Abdulla, S/o. Mohideen. On coming to know the above said abduction, he has taken the victim to his house and left there. Again, on 07.06.2022, at about 9.30 pm she was abducted. Based on the above said complaint, a case has been registered against the petitioner under Section 366 IPC. During the course of investigation it was found that the above said Sheik @ Sheik Abdulla has not involved in the second occurrence and hence, his name was deleted from FIR. The petitioner herein arrayed as A2 was arrested and remanded to judicial custody.
3. The learned counsel appearing for the petitioner submitted that the petitioner has not involved in the said offence and he has https://www.mhc.tn.gov.in/judis 1/2
CRL OP(MD). No.14463 of 2022 simply introduced the victim girl to the above said Sheik @ Sheik Abdulla and his name has been falsely implicated in this case.
4. The learned Additional Public Prosecutor appearing for the respondent would submit that this is the case of abduction and the the investigation of the case is pending.
5. Considering the fact that it is a second occurrence of abduction and that the name of the petitioner has been implicated in this case as A2 and that the nature of offence is very serious, this Court is not inclined grant bail to the petitioner.
