ORDER

This Writ Petition is disposed of at the time of admission with the consent of the learned counsel for the petitioner, learned Central Government Standing Counsel for the first respondent and Government Advocate (Crl.Side) for the second respondent.

2. The learned Government Advocate (Crl.Side) for the second respondent submits that an FIR has been registered against the petitioner in Crime No.176 of 2021 before the second respondent, in which case the charge sheet has been filed on 04.01.2022, before the learned Judicial Magistrate, Manamadurai. However, it has been returned for certain compliance and that it is being complied with.

3. Considering the same, there shall be a positive direction to the first respondent to re-issue the passport standing in the name of the petitioner applying 2/4

the decision of the Hon'ble Division Bench in the case of The Regional Passport Officer, Chennai Vs. Samsudeen Mohamed Salih and another, (W.A.No.902 of 2023, dated 02.06.2023). However, the passport shall be directly sent to the learned Judicial Magistrate, Manamadurai, after due intimation to the petitioner.

4. In case, the petitioner desires to travel abroad, the petitioner may move a suitable application before the learned Judicial Magistrate, Manamadurai, which is seized off the FIR registered against the petitioner in Crime No.176 of 2021 by the second respondent.
