This Writ Petition has been filed under Article 226 of the Constitution of India praying to direct the respondents 1 to 3 to put up compound wall in Government Adi Dravidar Welfare High School, Idaiyankulam Village, Virudhunagar District and also for directing the respondents 4 and 5 to register cases against anti social elements by way of issuing a Writ of Mandamus.
2.It is averred in the petition that the petitioner is a President of Parent-Teachers Association, Idayankulam Panchayat. In Idayankulam village, a Government Adi Dravidar Welfare High School is functioning. During night hours, some anti social elements are doing some illegal activities and in order to deter the same, various representations have been given to the first respondent. But the first respondent has not taken any proper steps and therefore, the present writ petition has been filed for getting the relief sought therein.
3.Mr.D.Muruganandham, learned Additional Government Pleader takes notice for the respondents.
4.The learned counsel appearing for the petitioner has contended that the school mentioned in the petition is not having compound wall on all four sides and due to that during night hours some anti social elements are making some chronic illegal activities and therefore, a representation has been given to the first respondent. But the first respondent has not shown any interest. Under the said circumstances, the present writ petition has been filed for getting the relief sought therein. 5.Considering the nature of relief sought in the writ petition and also considering the fact that already various representations have been given to the first respondent, this Court is of the view to allow the present petition. 6.In fine, this Writ Petition is allowed without cost.
The respondents 1 to 3 are strictly directed to put up compound wall on all four sides of the school mentioned in the petition within a period of three months. The respondents 4 and 5 are directed to register cases against anti social elements for doing illegal activities inside the premises of the school. Consequently, WMP (MD)No.17550 of 2016 is closed.
