PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Certiorari, calling for the records relating to the impugned punishment order passed by the 1st respondent in his proceedings in G.O.Ms.No. 78, Co-operative, Food and Consumer Protection Department Dated 16.07.2019 and quash the same as illegal.

ORDER

The present writ petition has been filed by the Deputy Tahsildar challenging G.O.(Ms).No.78, Co-operation, Food and Consumer Protection Department, dated 16.07.2019, wherein the petitioner has been imposed with the punishment of reduction to lower post of Revenue Assistant for a period of two years.

2. Pending writ petition, by way of proceedings of the first respondent in letter No.16203/CL1/2019-23, dated 21.05.2025, the order impugned in the Government Order is recalled. Paragraph No.2 of the said letter is extracted as follows:- "As the date of your superannuation falls on 31.05.2025 A.N., the undersigned proposes to adopt Revision under Rule 36 of Tamil Nadu Civil Services (D&A) Rules for the reason that the punishment already imposed against you (i.e.,) "Reduction to lower post of Revenue Assistant for 2 Years" was not implemented / unimplementable and the said punishment imposed against you in the G.O.(Ms.)No.78, Co-operation, Food and Consumer Protection Department, dated 16.07.2019 is hereby ordered to be set aside."

3. On 31.05.2025, the 3rd respondent has issued proceedings permitting the petitioner to retire from service with a condition to continue the proceedings under Rule 9 of Tamil Nadu Pension Rules. The said fact is also recorded. 2/4

4. In view of subsequent developments, no further orders are called for. Accordingly, this writ petiton stands closed. No costs. Consequently, connected miscellaneous petitions are also closed.
