PRAYER :- For Bail in Crime No.576 of 2023 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioner/Accused herein, who was arrested on 18.06.2023 for the alleged offence under Sections 379 of IPC r/w 21

(4) of Mines and Minerals Act, in Crime No.576 of 2023, on the file of the respondent police, seeks bail.

2.The case of the prosecution is that on 18.06.2023 at about 06.00a.m., the accused persons had illegally transported 5 units of river sand, without valid permit. Hence, the case. 3.The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. Hence, prays to release him on bail.

4.The learned Additional Public Prosecutor submitted that the petitioner is having 14 previous cases at his credit and the https://www.mhc.tn.gov.in/judis 1/2

CRL OP(MD). No.12409 of 2023 accused persons were illegally transporting mineral without valid permit. Hence, prays to dismiss the petition. 5.Considering the nature of offence and bad antecedents of the petitioner, if he is released on bail, he may abscond or indulge in similar kind of offence. So this Court is not inclined to grant bail to the petitioner.

6.Accordingly, this Criminal Original Petition stands dismissed.
