Petition filed under Article 226 of the Constitution of India, praying for the issuance of a writ of Mandamus to direct the 1st Respondent to direct the third Respondent to survey the lands and fixing the boundary marks in Survey No.43/3 its extent of 0.03.5 ares situated in Konnaiyur Village, Ponnamaravathy Taluk, Pudukkottai District, based on the petitioner's application dated 27.06.2016.

The petitioner seeks for a mandamus to direct the first Respondent to direct the third Respondent to survey the lands and fix the boundary marks in Survey No.43/3 its extent of 0.03.5 ares situated in Konnaiyur Village, Ponnamaravathy Taluk, Pudukkottai District, based on the petitioner's application dated 27.06.2016.

2. Heard both sides.

3. Needless to say that it is for the third respondent to consider the said application after giving opportunity of hearing to the petitioner as well as the rival claimants, if any and pass orders on merits and in accordance with law.

Therefore, without expressing any view on the claim made by the petitioner, the third respondent is directed to consider the petitioner's application dated 27.06.2016 after giving opportunity of hearing to the petitioner as well as the rival claimants, if any on merits and in accordance with law within a period of twelve weeks from the date of receipt of copy of this order.

5. With the above direction, this writ petition is disposed of. No costs.
