ORDER

This Criminal Original Petition is filed seeking police protection to the petitioner's life and limb based on his representation dated 17.06.2025.

2. The learned counsel for the petitioner submitted that he is the de facto complainant who had given a complaint against the third respondent herein, who has trespassed into his property and had caused a threat to his life and limb for which he had given a representation on 17.06.2025. However, the second respondent police has failed to consider his representation. Therefore, he sought for indulgence of this Court.

3. The learned Government Advocate submitted that the subject property which is comprised in survey No.198/8 at Pothampatti Village, Usilampatti Taluk, Madurai District is the ancestral property of the petitioner as well as the third respondent and the same has been declared in favour of the petitioner in a civil suit filed by the petitioner in O.S.No. 39 of 2022 on the file of the learned District Munsif / Judicial Magistrate 2/5

No.I, Usilampatti and the same was decreed in favour of the petitioner. Against which an appeal was preferred by the 3rd responder in A.S.No.7 of 2025 on the file of the Subordinate Judge, Usilampatti which was dismissed against which a Second Appeal in S.A.(MD)No.595 of 2025 was filed by the petitioner before this Court. In the Second Appeal, no injunction order has been passed. However, pending the Second Appeal, the petitioner has given a representation to the second respondent seeking police protection.

4. Heard both sides and carefully perused the materials available on record.

5. It is seen from the above submissions that a civil dispute is pending between the petitioner and the third respondent. Therefore, this Court do not find any merits on the petitioner's representation seeking police protection in the matter and the petitioner is directed to wait till a final decision is taken in S.A.(MD)No.595 of 2025. 3/5

6. With the above direction, this Criminal Original Petition is disposed of.
