JUDGMENT

(Judgment of the Court was made by G.R.SWAMINATHAN, J.) Heard both sides.

2. The writ petitioner's father died in harness. The writ petitioner had submitted an application seeking compassionate appointment. The management had also forwarded the recommendatory proposal to the Joint Registrar of Co-operative Society. The matter is being processed. At this stage, W.P.(MD)No.11394 of 2025 came to be filed. The learned Judge even while calling upon the Joint Registrar of Co-operative Society, Theni to pass order on the proposal dated 14.01.2020 sent by the appellant herein, also issued a positive direction for appointment. Aggrieved by the said direction, this writ appeal has been filed. 2/4

3. We are of the view that the learned single Judge could not have given a positive direction for appointment when the Joint Registrar is processing the matter. Therefore, we delete the expression "and appoint the petitioner in any suitable post". That alone stands deleted. In all other aspects, the order remains intact.

4. The Writ Appeal is partly allowed. No costs. Consequently, connected miscellaneous petition is closed.
