ORDER

Heard both sides.

2. The scope of this writ petition is confined to S.Nos.9, 11, 14, 15 & 16 of Kovilangulam Village. The case of the writ petitioner who is a resident of the village is that the sixth respondent is putting up solar panel in the water bodies.

3.The learned counsel appearing for the sixth respondent categorically states that in the survey numbers mentioned above, no solar panel has been put up. He had given a further undertaking that he will not put them up also.

4. The said undertaking is recorded. We direct the respondents 1 to 3 to ensure that the aforementioned survey numbers are maintained as water body and kept free of encroachment for all times to come. It appears that the sixth respondent has put up solar panel in the other survey numbers. The case of the writ petitioner is that they have been classified as water catchment area. But the record does not indicate so. We grant liberty to the petitioner to work out his rights against the sixth respondent in respect of those survey numbers in the manner known to law.

5. With the aforesaid liberty, the Writ Petition is allowed in respect of S.Nos. 9, 11, 14, 15 & 16. No costs. Consequently, connected miscellaneous petition is closed.
