The writ petition has been filed for issuance of a Writ of Mandamus, to direct the respondents to give permission and police protection to conduct the District Level Kabaddi Tournament by the Prince Kabadi Club on 27.12.2016 (Light Match) at Maruthakulam, by considering the representation, dated 12.12.2016. 2.Mr.K.P.Krishnadass, learned Government Advocate, took notice for the respondents. By consent, the writ petition itself is taken up for final disposal.
3.Heard the learned counsel appearing for the petitioner and the learned Government Advocate appearing for the respondents. 4.The learned Government Advocate would submit that the participants are not recognized teams and there is no regulation formulated by the organizers to fix the eligible criteria for the Kabadi Teams and in that area, there were so many occurrences happened during the Kabadi match in and around the village and if https://hcservices.ecourts.gov.in/hcservices/
permission is granted to conduct Kabadi Tournament, then it will lead to law and order problem in the area. Hence, he prayed for the dismissal of the petition.
5.It is seen from the counter filed by the 3rd respondent, it is stated that the petitioner village and the neighbouring villages are very prone to law and order issues during the festival period and therefore, it is not possible to grant permission during the temple festival. Except the above ground, no other valid grounds are stated in the counter to reject permission for the conduct of Kabadi Tournament. Hence, this court is of the considered view that a suitable direction can be issued to the 3rd respondent to consider the representation of the petitioner, dated 12.12.2016.
6.In view of the above circumstances, this petition is disposed of with a direction to the 3rd respondent police to consider the representation of the petitioner, dated 12.12.2016 and pass appropriate orders purely on merits and in accordance with law, within two days from today.
