ORDER
This criminal original petition has been filed to direct the learned Additional Sessions Court No.II, Tirunelveli District to complete the trial of the case pending before the Court in S.C. No.96 of 2016, within a time frame.
2.The learned counsel appearing for the petitioner would submit that the petitioner's wife is working as a village panchayat President at North Thalaiyuthu Village. Due to previous enmity, the private respondents herein abused the petitioner's wife and attacked her with deadly weapon and caused severe injury. Hence, the petitioner herein preferred a complaint and the same has been registered in crime No.213 of 2011 on the file of the first respondent police for the offence under Sections 341, 294(b), 323, 324 and 307 IPC and Section 4 of Tamil Nadu Prohibition of Harassment of Women Act, 2002 altered into Sections 341, 294(b), 323, 324 and 307 IPC r/w Section 3(i) (x) SC/ST (POA)Act, 1989. The first respondent police, after completion of investigation, filed the charge sheet in S.C.No.96 of 2016 before the learned Additional https://hcservices.ecourts.gov.in/hcservices/ 1/2
Crl.O.P.(MD)No.15097 of 2020 Sessions Court No.II, Tirunelveli District. He would further submit that the though the charge sheet has been filed in the year 2016, there is no progress in the trial and the case is pending for four years. Hence, the petitioner filed the present petition seeking the aforesaid relief.
3.Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the first respondent. 4.Considering the facts and circumstances of the case and also considering the fact that the case in S.C.No.96 of 2016 is pending from the year 2016, this Court directs the learned Additional Sessions Court No.II, Tirunelveli District to complete the trial in S.C.No.96 of 2016 and dispose of the same, within a period of six months from the date of receipt of a copy of this order. 5.With the above direction, this criminal original petition is allowed.
