For Petitioner : Mr.G.Mathavan For R1 and R2 : Mr.B.Thanga Aravindh Government Advocate Crl.Side) O RDER This Writ Petition is filed seeking for a direction to the police to dispose of the representation given by the petitioner dated 18.01.2023, requesting them to enquire into execution of registered sale deed on 02.08.1985, in respect of the property belongs to them, as if it was executed by the petitioner's father.

According to the petitioner, his father died on 30.07.1985, however, somebody by impersonating his father, got a registered document executed on 02.08.1985, by way of forgery as if his father has executed the document. It is submitted by him that recently third respondent has filed a writ petition before this Court seeking for a direction to the police for providing police protection for conducting survey in respect of the land belonging to the petitioner. Only then, the petitioner realized that third respondent got a forged document registered, as if his father had executed a sale deed on 02.08.1985. It is also submitted that the petitioner stated to have filed Writ Appeal and the same is pending.

The learned Government Advocate (crl.side) on the other hand represents that since the matter relates to a dispute in respect of a immovable land property, as per the learned standing instruction, the representation submitted by the petitioner dated 18.01.2023 has been referred to Land Disputes Redressal Committee on 14.03.2023. It is to be noted that the representation of the petitioner is to investigate the alleged offence of forgery in respect of execution of a document on 02.08.1985, by way of impersonation, as if his father had executed the sale deed when he died on 30.07.1985.

Therefore, the police are directed to enquire into the representation dated 18.01.2023 and complete the investigation either to file a First Information Report or close the same by informing the same to the petitioner within a period of four weeks from the date of receipt of a copy of this order.
