Petition filed under Article 226 of the Constitution of India, praying for the issuance of a writ of Mandamus calling for the records relating to the proceedings of the Sub Collector Paramakudi 3rd Respondent in Pa.MUu.A3/7302/2016 dated 25.11.2016 and 01.12.2016 in respect of the lands of the petitioner situate in survey No.11 of an extent of 0.22.5 at Kamuthakudi Group Paramakudi Taluk Ramanathapuram District and quash the same consequently direct the 3rd respondent to reconsider the case of the petitioner with relevant documents as per law.

This writ petition is filed challenging the order passed by the third respondent in cancelling the assessment of land.

2. Heard both sides.

3. It is seen that as against the order passed by the third respondent which is impugned in this writ petition, appeal lies to the District Revenue Officer, Ramanathapuram. Therefore, the petitioner has to exhaust such alternative remedy. Without doing so, the present writ petition cannot be entertained.

4. Accordingly, this writ petition is dismissed only on the ground that the petitioner has to avail alternative remedy of appeal. The petitioner is at liberty to file such appeal before the second respondent within a period of three weeks from the date of receipt of copy of this order. onthemerit of the claim made by the petitioner. Consequently, connected W.M.P.(MD) No.17640 of 2016 is also dismissed.
