For Respondent : Ms.Anantha Devi, Government Advocate (Crl.Side) Petition for modification under Section 439(2) of Cr.P.C PRAYER :- To Modify the condition imposed by the court of the Judicial Magistrate Tirumangalam in Crl.M.P (MD) No. 4526/2019 on 05.08.2019 in respect of directing the Petitioner to appear and sign before the All Women Police station Tirumangalam daily at 10.30 a., for a period of thirty days and permit him to appear before the respondent police on every Saturday and Sunday at 10.30 AM for a period of four weeks.
ORDER : The Court Made the following order :- This petition has been filed to modify the condition imposed by the learned Judicial Magistrate, Thirumangalam in Cr.M.P.No.4526 of 2019, dated 05.08.2019.
2. The learned counsel for the petitioner would submit that the petitioner was granted bail by the learned Judicial Magistrate, Thirumangalam on 05.08.2019, directing the petitioner to appear before the Thirumangalam All Women Police Station daily at 10.30 a.m for a period of thirty days. He further submitted that the petitioner is a Government Servant and he is working at Chennai and hence he is unable to appear before the respondent police daily https://hcservices.ecourts.gov.in/hcservices/
at 10.30 a.m. Therefore he prays to modify the said condition.
3. Taking into consideration the facts and circumstances of the case and also the fact that the petitioner is complying the condition without any deviation, the condition imposed by the learned Judicial Magistrate, Thirumangalam in Cr.M.P.No.4526 of 2019 is modified to the effect that the petitioner shall report before the respondent police on first Sunday of every month at 10.30 a.m until further orders. All other conditions in the said order shall remain unaltered.
