PRAYER : Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus, directing the respondents 1 to 3 to consider the petitioner's representation dated 11.01.2020 and consequently direct the respondents 1 to 3 to take effective steps to remove the encroachment by the 4th respondent and to protect the tank from the encroachers from dumping the waste by allowing the villagers to fence the tank and the temple in S.No.750 to an extent of 85 cents of Vethalai Village, Mandapam Sub Division, Ramanathapuram Taluk, Ramanathapuram District in order to maintain the sanctity of the tank and temple. (Order of the Court was made by S.M.SUBRAMANIAM, J.) Today, when the matter is taken up for hearing, the learned Government Pleader appearing for the respondents 1 to 3, on instructions, 2/5

submitted that no encroachment has been identified in Survey No.750 situated at Vethalai Village, Mandapam Sub Division, Ramanathapuram Taluk, Ramanathapuram District.

2.The learned counsel appearing for the petitioner submitted that certain individuals are dumping garbage in the said survey number. 3.If so, the petitioner is at liberty to give a fresh complaint for the initiation of appropriate action.

4.With these observations, this Writ Petition is disposed of. There shall be no order as to costs. Consequently, connected Miscellaneous Petition is closed.
