Petition filed under Article 226 of the Constitution of India, praying for the issuance of a writ of Mandamus directing the respondent to consider the petitioner's representation dated 29.11.2016 and direct the respondent to issue the deposit amount of Rs.12,79,458/- which was deposited by the petitioner in the name and style of M.Kodiarasu Third Class Contractor petitioner's contract Licence No. k.bgh.4/13408/16 for the public work for the period of 2005 to 2016.

The petitioner seeks for a direction to the respondent to consider his representation dated 29.11.2016, through which, he sought for refund of the deposit amount of Rs.12,79,458/- said to have been deposited by the petitioner in the name and style of M.Kodiarasu Third Class Contractor in Licence No. k.bgh.4/13408/16 for the public work for the period of 2005 to 2016. 2.Whether the petitioner is entitled to get such refund or not is for the respondent to consider and decide and therefore, this Court, at this stage, is not expressing any view on the claim made by the petitioner. Therefore, this writ petition is disposed of only with a direction to the respondents to consider the representation of the petitioner, dated 29.11.2016 and pass orders on the same on merits and in accordance with law, within a period of six weeks from the date of receipt of a copy of this order. No costs.
