Writ Petition is filed under Article 226 of the Constitution of India, praying this Court To issue a Writ of mandamus, forbearing the 1st and 2nd respondents from allowing the 3rd respondent from putting up any construction in survey no. 34/6, sattur Town without a valid permission for building and also not to allow the 3rd respondent to encroach upon the petitioners possession and also consequently forbearing the 1st and 2nd respondents from allowing the 3rd respondent from any way dusturbing the peaceful possession of the petitioner admeasuring 41.38 cents. ORDER
Alleging non compliance of the order made in W.P.(MD)No.13420 of 2009 dated 25.03.2019, the present contempt petition has been filed.
2.The above writ petition was filed to issue a Writ of Mandamus, forbearing the 1st and 2nd respondents from allowing the 3rd respondent from putting up any construction in survey No.34/6, Sattur Town without a valid permission for building and also not to https://hcservices.ecourts.gov.in/hcservices/ 1/2
Contempt Petition(MD)No.1114 of 2019 allow the 3rd respondent to encroach upon the petitioner's possession and also consequently forbearing the 1st and 2nd respondents from allowing the 3rd respondent from any way disturbing the peaceful possession of the petitioner admeasuring 41.38 cents. 3.This Court by order dated 25.03.2019 directed the 1st respondent to inspect the building of the petitioner and if the petitioner has violated the planning permit or has constructed the same without planning permit, the 1st respondent was further directed to initiate appropriate legal action against the 3rd respondent within two weeks from the date of inspection. 4.Today, when the contempt petition was taken up for hearing, learned counsel for the respondent would state that as per the orders of this Court, the respondent has initiated action against the 3rd respondent by issuing notice dated 27.12.2019 calling upon the 3rd respondent to produce the planning permission for his building and would further state that the proceedings will be completed within four weeks.
