ORDER

This Writ Petition is filed seeking to issue Writ of Mandamus directing the 3rd Respondent to provide NOC certificate and re-register the process of the petitioners firearm licence, release the firearm deposited before the police authorities.

2. The petitioner joined CRPF in the year 1991 and he had lawfully purchased 12 Bore firearm and obtained Firearm License No.K/293/D/OMS/09 dated 22.06.2009 from the competing authorities. At the time of purchase, no objection certificate was issued by the competing authority. From the date of acquisition, he had maintained the firearms strictly in accordance with law and as per the departmental regulations. During 2024, at the time of Loksabha election, he was 2/6

directed to surrender the gun at police station at Madurai on 26.03.2024. The same was periodically renewed and the same is not yet returned. The license remained valid up to 22.06.2024. Since the petitioner was continuously working outside Tamil Nadu, he was not able to process his renewals. For the purpose of renewing, he requires no objection certificate from the respondent police. In this regard, the petitioner had given a representation, the same is not considered. Hence this Writ Petition.

The learned Government Advocate submitted that for the purpose of issuance of no objection certificate, facilitating the petitioners processing of renewal, it is significant that he can produce the 12 digit unicode number along with the purchase invoices of the said firearm. In the absence of the same, the respondent police is handicapped in issuing the same. He also draw my attention to the fact that already the District Collector has passed an order dated 14.09.2021 had issued instructions, not to give NOC.

4. Heard either sides and carefully perused the materials available on record.

5. In view of the above submission, giving liberty to the petitioner to challenge the communication of the District Collector, this writ petition is disposed of. It is made clear that if at all the petitioner is able to get necessary permissions from the competent authority including the District Collector, the respondent police should facilitate issuance of NOC. The petitioner is also directed to produce all the necessary documents as required by the respondent police and on receipt of the same, the respondent is directed to process the same. 22.06.2026 NCC : yes / no Index : yes / no pnn 4/6
