PRAYER: Criminal Original Petition is filed under Section 528 of BNSS Act, to direct the learned special court for trial of cases under SC/ST (POA) Act, karur to accept the surrender of the petitioners and consider their bail application on same day in connection with crime No.165 of 2026 on the file of the 2nd respondent police and pass such further or other orders. 1/4

ORDER

The present petition has been filed by the Accused Nos.2 & 4, 5 to 7 in Crime No.165 of 2026, on the file of the second respondent police seeking a direction as against the trial Court to consider the bail application of the petitioners on the same day of surrender.

2. Since the 2nd Petitioner/Accused No. 4 has already been arrested, this petition stands dismissed as against the 2nd petitioner/Accused No. 4.

3. Considering the averments in the petition, there shall be a direction to the Special Court for trial of cases under SC/ST (POA) Act, Karur, to consider the bail application of the petitioner Nos.1,3 to 5/Accued Nos.2, 5 to 7 on the same day of surrender in Crime No.165 of 2026, after giving due opportunity to the defacto complainant.

4. The petitioner Nos.1,3 to 5/Accued Nos.2, 5 to 7 shall surrender before the concerned Court on or before 30.06.2026.

5. With the above said observations, this Criminal Original Petition stands partly allowed.
