ORDER

Heard the learned counsel for the petitioner, learned Central Government Standing Counsel for the first respondent and learned Government Advocate (Crl.Side) for the second respondent.

2. The learned Government Advocate (Crl.Side) for the second respondent submits that the petitioner is an accused No.2 in Crime No.430 of 2017.

3. It is further submitted that charge sheet has been filed and the case is pending before the Sub Court, Sankarankoil in S.C.No. 688 of 2018 for the offences under Sections 147, 148, 294b, 307, 323, 324, 342 and 506(ii) IPC.

4. Considering the same and in view of the restrictions under Section 6(2) (e) of the Passport Act, 1967, there cannot be a direction straight away to renew 2/4

passport to be handed over to the petitioner.

5. Considering the fact that the case is pending against the petitioner, however, in view of the decision of the Hon'ble Division Bench of this Court in The Regional Passport Officer, Chennai Vs. Samsudeen Mohamed Salih and another (W.A.No.902 of 2023, dated 02.06.2023), there shall be a direction to the first respondent to process the passport application of the petitioner as expeditiously as possible and the same shall be transferred to the file of the Sub Court, Sankarankoil to be kept in S.C.No.688 of 2018.

6. In case, the petitioner desires to travel abroad, the petitioner may move suitable application before the Sub Court, Sankarankoil for retrieving the passport for travel purpose.
