For Respondent : Mr.T.Senthil Kumar, Additional Public Prosecutor PETITION FOR BAIL Under Sec.439 of Cr.P.C PRAYER :- For Bail in Crime No.130 of 2019 on the file of the respondent police ORDER : The Court made the following order :- The petitioner/Accused, who was arrested on 22.12.2019, in connection with the case in Crime No.130 of 2019, registered for the offence under Sections 8(c) r/w 20 (b) (ii)(c), 25 & 27 A and 29(1) of NDPS Act, on the file of the respondent police, seeks bail. 2.The case of the prosecution is that the petitioner was found in illegal possession of 2 Kgs of Ganja. Hence, the case was registered against the petitioner.
3.The learned counsel for the petitioner submitted that the petitioner is an innocent person and she has been falsely implicated in this case. He further submitted that based on the confession statement of the co-accused alone, the petitioner's name is implicated in this case. He would further submit that the petitioner was arrested and remanded to judicial custody on 11/12/2019. 4.It is reported by the learned Additional Public Prosecutor, that the petitioner is having eight previous cases to her credit. 5.Considering the nature of offence and the antecedents of the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
