ORDER

The present writ petition is filed for a mandamus directing the respondents to remove the Thar Road laid within the Petitioner's Patta Land in S.F.No.301/6A situated at Meenakshipuram Village, Ottapidaram Taluk, Thoothukudi District, to an extent of 30 cents by considering the petitioner's representation dated 10.02.2025.

2. The learned Government Pleader appearing for the 1st respondent on instructions submitted that the said road was an existing road for the past 40 years. Moreover, the said land belongs to Kayathar Panchayat as well as Ottapidaram Panchayat and it is not a Patta land. However, the petitioner submitted this as a Patta land. Therefore, it is to be resolve by surveying the land. The 1st respondent is directed to survey the land by issuing notice to the petitioner, then conduct enquiry and thereafter, pass appropriate order in accordance with law. In case, if it is found that the petitioner's land is taken for putting up the Thar Road, the petitioner is entitled to compensation under the acquisition proceedings.

3. With these directions, the writ petition stands disposed of. No costs.
