O R D E R
This petition has been filed seeking direction to the respondent police to not to harass the petitioner and not to interfere in the contractual obligation.
2.When the matter is taken up for hearing, the learned counsel for the petitioner submitted that there was a contract to supply the journals to the Medical College, Madurai and it is a purely contractual obligation, breach of which does not lead to any criminal liability. But however, based upon the complaint given by the Madurai Medical College, the respondent is making harassment. 3.The learned Additional Public Prosecutor submitted that based on the complaint given by the Dean, Madurai Medical College, Madurai, a case has been registered against this petitioner in Crime No.24 of 2021 for the offences punishable under Sections 406 and 409 of IPC and the investigation is pending.
4.Since a case has been registered against the petitioner, the prayer sought for in the petition has become infructuous. The petitioner has to work out his remedy through appropriate proceedings.
