To Condone the Absence of the petitioners in complying the order of this Court dated 10.06.2025 in Crl.M.P.(MD)No.7116 of 2025 in Crl.M.P.(MD)No.4772 of 2025 in Crl.A. (MD) No.267 of 2025.

ORDER

The petitioners have been found guilty, convicted by the II Additional District Court for CBI cases, Madurai in C.C.No.4 of 2012 by Judgment dated 05.02.2025.

2. In the appeal filed by these petitioners, this Court has granted an interim suspension with https://www.mhc.tn.gov.in/judis

certain conditions vide order dated 30.04.2025 in Crl.M.P.(MD)No.4772 of 2025. Subsequently, the condition was also modified vide order dated 10.06.2025 in Crl.M.P. (MD)No.7116 of 2025. Now, this petition has been filed to condone the absence of these petitioners before the Trial Court on 01.06.2026.

3. The learned counsel appearing for the petitioners submits that these petitioners are siblings and they failed to appear before the Trial Court on 01.06.2026, since their father died.

4. The learned standing counsel appearing for CBI, on verification, confirms that the father of the petitioners died on 01.06.2026 and their absence could be condoned.

5. Considering the submissions made on either sides, the absence of these petitioners before the Trial Court on 01.06.2026 is condoned and this Criminal Miscellaneous Petition is ordered. The petitioners have to appear before the Trial Court for future hearings, without any default.
