PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Mandamus, directing the second respondent to complete the speedy enquiry on petitioner's complaint dated 12.06.2025 and to take necessary action, in accordance with law, within the time stipulated by this Court. The petitioner with a grievance that his complaint has not been enquired by the respondent police has filed this writ petition.

2.Mr.E.Antony Sahaya Prabahar, learned Additional Public Prosecutor, who takes notice for the respondents 1 & 2 submits that this petitioner has lodged a complaint directly before the Inspector General of Police, South Zone and the same has been forwarded to the second respondent and it was received by the second respondent only on 29.06.2025. Now, they are conducting a petition enquiry in CSR No.244 of 2025.

3.The learned counsel for the petitioner submits that this is a case of cheating by creating a fake legal heir certificate. Though the complaint constitutes a cognizable offence, the respondent police has not taken any action so far.

4.This Court considered the rival submissions made and also perused the materials placed on record.

5.The respondent police has treated the petitioner's complaint as petition inquiry in CSR No.244 of 2025. The petitioner claims that the allegation is of creation of fake legal heir certificate and the complaint of this petitioner constitutes a cognizable offence, however, the respondent police has not come forward to register a case. In the event, if it is found that a fake legal heir certificate has been issued, then the respondent police has to treat as if a cognizable offence is made out and to proceed further by registering a case. The respondent police are directed to conclude the enquiry on the petitioner's complaint, within a period of three weeks from the date of receipt of a copy of this order.

6.With the above direction, this writ petition is disposed of. No costs.
