O R D E R

This writ petition has been filed seeking for a direction to the 1st respondent to renew the petitioner's Passport No.M3116977 based on the representation, dated 26/11/2024 preferred by the petitioner within a time frame. 2.Heard the learned counsel appearing for the petitioner and the learned Standing Counsel appearing for the 1st respondent as well as the learned Government Advocate (Criminal Side) appearing for the 2nd respondent. 3.The petitioner has applied for renewal of the Passport, vide Passport Application No.MD1077152533924, dated 26/11/2024. The petitioner was a holder of the Passport No.M3116977 which was valid between 21/10/2014 and 20/10/2024. The petitioner appears to be an accused in Crime No.180 of 2013 on the file of the Samayanallur Police Station, Madurai District for the offences under section 41(A) Cr.P.C & 120 Cr.P.C @ 418 and 420 IPC.

4.The learned Government Advocate (Criminal side) appearing for the 2nd respondent would submit that charge sheet has been filed before the Judicial Magistrate, Vadipatti on 31/05/2023, however, charge sheet has not been taken on file.

5.Since charge sheet has not been taken on file, there can be no impediment for processing the Passport of the petitioner. Therefore, there shall be a direction to the first respondent to process the passport application of the petitioner. However, it is made clear that in case, charge sheet is taken on file, the petitioner shall voluntarily surrender the passport before the Judicial Magistrate, Vadipatti. Liberty is also given to the second respondent to take steps to seize the passport from the custody of the petitioner in case the petitioner failed to comply with the above stipulations.

6.With the above said direction, this writ petition stands disposed of. No costs.
