PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, directing the respondents 1 and 2 to take necessary action against the fifth respondent for sand and gravel theft done by the fifth respondent in petitioner's land and ensure that the petitioner is monetarily compensated by the fifth respondent for the loss incurred by the fifth respondent within time stipulated by this Court based on the petitioner's representation dated 11.06.2023.

This Writ Petition is filed seeking for a direction to the respondent Police to conduct an enquiry in respect of the representation given by the petitioner dated 11.06.2023.

2. Learned counsel for the petitioner submits that he has been the owner and possessor of the property in Survey Nos.465/12, 466/2B2, 466/2E, 468/1 and 468/3 admeasuring to an extent of 0.23 acres, situated in Marasilambu Village, Palani Taluk, Dindigul District. The respondent No.5 stated to have committed theft of sand and gravel from the land belonging to the petitioner, which is worth of Rs.30,00,000/- and with regard to that, a representation has been given to the second respondent Police. However, no action has been initiated so far.

3. Learned Government Advocate (Criminal Side) submitted that they have received a petition and the same is assigned as C.S.R.No.146 of 2023 and assured that they will initiate the enquiry and complete the same within a period of two weeks from today. The same is recorded. 2/4
