Petition filed praying that in the circumstances stated therein and in the petition filed therewith the High Court may be pleased to modify the condition No.7 as to deposit the original title deeds jointly stands in their name or friends or relatives to the tune of Rs.50,00,000/- within the proper valuation certificate issued by the authorities.

Prayer in CRL MP(MD). 9567/ 2023 :

To extend time for 6 weeks period for producing sureties before the Special Court under the Tamilnadu Protection of Interest of Depositors Act 1997, Madurai in Crime No.1/2023 in Crl.OP(MD)No.7916/2023 on 05.06.2023 Order : These petitions coming up for orders on this day, upon perusing the 1/3

petitions filed in support thereof and upon hearing the arguments of M/S.SUSI KUMAR C, Advocate for the petitioners in both petitions and of MR.M.VAIKKAM KARUNANITHI, Government Advocate (Criminal Side)on behalf of the Respondent, the court made the following order:- These petitions been filed by the petitioner to modify the condition imposed in Crl.OP(MD)No.7916 of 2023 dated 05.06.2023 and seeks extension of time.

2.The grievance of the petitioner is that the second accused namely Ragunath has been granted regular bail, by the learned Special Judge, TNPID Act Cases without making any condition to the sureties on 19.04.2023. However, the petitioner was granted anticipatory bail by this Court on 05.06.2023 with conditions. 3.Only the latest order will prevail. Though it is submitted that the second accused is the Managing Director and he is responsible for day to day affairs of the Company, the said facts will be considered only at the time of investigation and by the trial Court. On that ground, the relief sought by the petitioner to modify the condition does not lie.

4.At the time of interim bail while the petitioner was complying the condition before the respondent Police Station there was apprehension on the side of depositors. Therefore, the petitioner is directed to appear before the concerned trial Court daily at 10.30 a.m., for a period of six weeks. The time is also extended for a period of one month, from the date of receipt of a copy of this order. 2/3

5.Accordingly, the petition seeking modification is dismissed and the petition seeking extension of time is allowed.
