Prayer: Writ Petition is filed under Article 226 of the Constitution of India, praying this Court Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus, calling for the records of the 2nd respondent 03.11.2020 in Registration No. B-2020-33-5-5292-001095 and quash the same, as the same is arbitrary, ultravires and consequentially direct the 2nd respondent to issue a fresh birth certificate of minor male child (S. Mrithunjayan) including the biological parents name Vennila as a Mother and Saravanakumar as a Father and pass such further or other orders as this Honble Court may deem fit and proper in the circumstances of the case and thus render justice. ORDER
This writ petition is filed with a prayer to call for the records relating to the registration of birth in respect of minor child, S.Mrithunjayan and to quash the same and consequently enter the correct name of the biological parents Vennila as the mother and Saravanakumar as the father.
2.This writ petition is disposed of at the admission stage,
without notice to the private parties. In view of the nature of relief that is being granted, this Court is not expressing any opinion on the merits of the issue.
3.When an application is made by the petitioner to the second respondent who is entitled to make corrections in accordance with law, the same shall be considered in accordance with law, due notice to the petitioner as well as to the respondents 5 and 6 shall be made and the issue should be decided by the 2nd respondent in accordance with law. 4.The writ petition is disposed of on the following terms: (i)The representation of the petitioner dated 20.02.2026 shall be taken up for enquiry by the 2nd respondent, due notice to the petitioner and the private respondent shall be issued after conducting of due enquiry, orders in accordance with law shall
be passed as expeditiously as possible, in any event not later than 4 weeks from the date of receipt or other web copy of the order. No costs. Consequently, connected miscellaneous petition is closed.
