PRAYER :-For Bail in Crime No.202 of 2022 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioner/Accused, who was arrested on 03.06.2022 for the alleged offence under Section 174 Cr.P.C., @ 120(B) and 302 IPC, in Crime No.202 of 2022, on the file of the respondent police, seeks bail.

2.The case of the prosecution is that the accused persons made trouble to the deceased demanding money for the purpose of starting business. Because of the above said issue, the petitioner and other accused said to have assaulted the deceased with Nylon rope and caused death of the deceased. After the above said occurrence, the petitioner was very much available in the place itself and he was secured from there.

3.The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution.

CRL OP(MD). No.14506 of 2022 4.The learned Additional Public Prosecutor submitted that there is no previous case against the petitioner and the investigation of the case is pending.

5.Considering the period of incarceration and the fact that the petitioner is not having any previous case, this Court is inclined to grant bail to the petitioner with stringent conditions. 6.Accordingly, this Criminal Original Petition is allowed and the petitioner is ordered to be released on bail, on executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Sathankulam, Thoothukudi District, and on further condition that the petitioner shall report before the respondent police daily at 10.30 a.m. until further orders. sd/- 17/08/2022 / TRUE COPY / 17/08/2022 Sub-Assistant Registrar (C.S.)
