ORDER : The Court made the following order :- The petitioner/sole Accused, apprehending arrest at the hands of the respondent police for the alleged offences punishable under Sections 294(b), 324 and 506(i) of I.P.C r/w Section 4 of TN Prohibition of Harassment of Women Act, 2002, in Crime No.123 of 2022 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that the defacto complainant lodged a complaint stating that she got one daughter and a son. The son was married to one Anjalai and they got two children. Because of the matrimonial issue, they got separated. Now, the daughter-in-law is living in her parental home along with her children. On 05.08.2022, at about 03.45 p.m, the defacto complainant went to her daughter-in-law's house for the purpose of making compromise and at that time, the accused person, who is the brother of her daughterin-law picked up quarrel with her and caused assault and also abused her in filthy language. Over which, the present case has been registered.

3. The learned counsel for the petitioner submitted that the petitioner is innocent and he has been falsely implicated in this case. He further submitted that injured was discharged from the hospital and no previous case is pending against the petitioner. Hence, he prays for grant of anticipatory bail to the petitioner.

CRL OP(MD). No.14458 of 2022 the hospital and no previous antecedent is reported against the petitioner.

5. Considering the facts and circumstances of the case and also considering the fact that because of matrimonial issue between the son of the defacto complainant and the sister of the petitioner herein, again trouble has arisen, the injured was discharged from the hospital and no bad antecedents reported against the petitioner, this Court is inclined to grant anticipatory bail to the petitioner.

Accordingly, this Criminal Original Petition is allowed and petitioner is ordered to be released on bail in the event of arrest or on his appearance, before the learned Judicial Magistrate, Manapparai, Trichy District, on condition that the petitioner shall execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and the petitioner shall appear before the respondent police daily at 10.30 a.m. until further orders. The petitioner shall comply with the condition stipulated under Section 438 Cr.P.C. scrupulously.

7. The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed.
