PRAYER: Petition filed under Article 226 of the Constitution of India, to issue a Writ of Habeas Corpus, directing the first respondent herein to produce the body or person of detenue namely Sathiyamoorthy, S/.Viswanathan aged about 28 years before this Court considering the representation sent by the petitioner dated 23.06.2025 and set him at liberty forthwith.

[Order of the Court was made by A.D.JAGADISH CHANDIRA, J.] This Habeus Corpus Petition has been filed to direct the first respondent herein to produce the body or person of detenu namely Sathiyamoorthy, S/.Viswanathan aged about 28 years before this Court considering the representation sent by the petitioner dated 23.06.2025 and set him at liberty forthwith.

2. Alleging that the husband of the petitioner namely Sathiyamoorthy aged about 28 years was taken to illegal custody by the special team of police and subsequently his whereabouts is not known, the present petition has been filed before this Court.
3. When the matter is taken up for hearing today, the learned Additional Public Prosecutor submitted that the husband of the petitioner is a habitual offender involved in several cases in various police stations in Madurai District and that he was arrested at 05.15 pm., on 26.06.2025 near Puttuthoppu Sivankovil, Madurai District in connection with Crime No.336 of 2025 registered for the offence under Section 310(4) of BNS and he was remanded to judicial custody by the learned Judicial Magistrate No.V, Madurai. He would further submit that he is not under illegal detention of anybody and the said arrest was also intimated to one of his friend namely Vijayakumar. Page No.3 of 6
