Prayer : Criminal Original Petition filed under Section 528 of Bharatiya Nagarik Suraksha Sanhita, to direct the respondent No.4 herein to comply with the order dated 30.04.2025 made in CrMP.No.694 of 2025 on the file of the Judicial Magistrate No.II, Ramanathapuram and consequently register an FIR.

ORDER

The petitioner has approached this court with a grievance that her complaint referred by the learned Judicial Magistrate has not been attended by the respondent police.

2.The learned Government Advocate (Crl Side) on instructions submits that the complaint of the petitioner has been referred by the learned Judicial Magistrate on 30.04.2025. The petition is the 1st wife of one Akbar Ali and the 1st respondent is the 2nd wife. The nature of complaint is the 1st respondent has obtained legal heir certificate and created some forged documents. Since the complaint has been forwarded on 30.04.2025, they would conduct an enquiry and proceed further in accordance with the enquiry report.

3.The complaint of the petitioner has been referred by learned Judicial Magistrate on 30.04.2025 and it is not proper on the part of the respondent police to keep the complaint pending for two months without conducting investigation. Therefore, the respondent police are directed to 2/4

conduct an enquiry and take a call within a period of two weeks from the date of receipt of a copy of this order.
