PETITION FOR ANTICIPATORY BAIL Under Sec.482 of BNSS PRAYER :- For Anticipatory Bail in Crime No.86 of 2025 on the file of the Respondent Police. ORDER : The Court made the following order :- The petitioner/A4, who apprehends arrest at the hands of the respondent police for the offences punishable under Section 6(4) of TN Scheduled Commodities (RDCS) Order, 1982 r/w. Sections 7(1)(a)(ii) of Essential Commodities Act, 1955 in Crime No.86 of 2025 on the file of the respondent police, seeks anticipatory bail.
2. The case of the prosecution is that on 23.06.2025, the accused smuggled 1880 Kilograms of PDS rice using a Mahindra Bolero vehicle bearing Registration No.TN11-AA-0480. Hence, the present case.
3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and has not committed any offence as alleged by the prosecution. He, however, submitted that the petitioner is ready to abide by any conditions that may be imposed by this Court. Hence, he seeks anticipatory bail to the petitioner. 2/4
4. The learned Government Advocate (Criminal Side) submitted that there are totally four accused persons in this case and the petitioner has been arrayed as A4. A1 to A3 were arrested and are still in custody. He further submitted that the investigation in this case is still pending. Hence, he opposed to grant anticipatory bail to the petitioner.
5. Considering the facts and circumstances of the case, and also taking note of the fact that the FIR was registered on 23.06.2025 and the case is at a preliminary stage of investigation, and that the co-accused were arrested and are still under custody, this Court is not inclined to grant anticipatory bail to the petitioner at this stage.
