ORDER

The petitioner is an accused in Crime No.804 of 2024. The second respondent has registered a case against the petitioner alleging that, on 17.12.2024 at about 11:00 p.m., the petitioner was involved in rash and negligent driving. When the respondent police attempted to intercept him, the petitioner allegedly abused the police personnel and caused damage to the battery light.

2. According to the petitioner, the entire incident has been recorded on the dashboard camera of his vehicle. He intends to produce the said recording before the Court. Hence, the petitioner has filed the present writ petition seeking issuance of a Writ of Mandamus, directing the respondents to receive and preserve the electronic record namely, the dashboard camera recording of the petitioner's vehicle bearing Registration No. TN-58-AL-1018 after obtaining expert opinion, pending disposal of the criminal trial in C.C. No.262 of 2025. It is further submitted that the investigation has been completed and a final report has been filed. The case has been taken 2/5

on file in C.C. No.262 of 2025 and is now pending before the learned Judicial Magistrate No.IV, Madurai.

3. The learned Additional Public Prosecutor appearing for the respondents submits that the respondents have no objection to receive the CCTV/dashboard camera recording and preserve the same after obtaining an expert opinion.

4. This court considered the rival submissions of both the learned counsels.

Since the investigation has already been completed and the final report has been filed, this Court permits the petitioner to file an appropriate application before the concerned Judicial Magistrate. Upon such filing, the concerned Judicial Magistrate shall direct the respondent police to obtain the necessary certification under Section 65B of the Indian Evidence Act. Accordingly, this writ petition is disposed of.
