ORDER
Heard the learned counsel for the petitioner, Mr.Dninesh Hari Sudarsan, learned Counsel for Government appearing for the respondents 1 and 2 and the learned counsel for the third respondent.

The petitioner herein, who was appointed as a Vice Principal in the year 2024, has participated in promotion and transfer counselling for the post of the Vice Principal in Medical Education and Research Department, of the State. Thereafter, the petitioner came to understand that the seniority list for promotion and transfer counselling has been prepared by considering CML seniority instead of station seniority.

According to the learned counsel for the petitioner, the seniority list is to be prepared for transfer counselling in terms of orders issued by the Government in G.O.(2D)No.131 Health Family Welfare (A1) Department dated 20.11.2007. But in the instant transfer counselling, the same has not been followed by the respondents. According to him, it is by virtue of the erroneous preparation of seniority list for transfer counselling, the third respondent herein is getting priority over the petitioner though the petitioner herein was appointed as a Vice Principal ahead of the third respondent. It is also brought to the notice of this Court that the petitioner has already submitted a representation dated 05.03.
2026 immediately after the transfer counselling, ventilating his grievance and also pointing out the defects in preparation of the seniority list for transfer counselling. As the respondents have not taken any further action on the said representation, the petitioner has approached this Court by filing the present writ petition. The learned counsel for the petitioner further submits that pursuant to transfer counselling that took place on 02.03.2026, no consequential orders have been issued by the respondents 1 and 2 as on date.

4.Mr.M.Dinesh Harisudarsan, learned Government Counsel appearing for the respondents 1 and 2 also confirmed that no orders have been issued by the respondents pursuant to the counselling already took place on 02.03.2026.
5. The learned counsel appearing for the third respondent seeks time for getting instructions and for filing counter.
6. This Court has carefully considered the submissions made by the learned counsels on either side and also perused the entire materials.

As the petitioner has already submitted a representation ventilating his grievance as early as on 05.03.2026 and the same is pending for consideration before the second respondent, this Court deems it appropriate to allow the second respondent to take a call on the representation already submitted by the petitioner instead of enquiring into the contentions raised by the petitioner in the present writ petition. As this Court is not passing any positive order in favour of the petitioner 4/7
nor affecting any of the rights of the third respondent herein, this Court does not see any reason to grant time for filing counter by the third respondent in the present writ petition, especially taking into consideration the nature of disposal of the writ petition.

In the light of the above, this writ petition is disposed of directing the second respondent to consider the representation dated 05.03.2026 submitted by the petitioner as expeditiously as possible, at any rate, within a period of six weeks from the date of receipt of a copy of this order by duly putting the third respondent on notice.
